California probate belongs to the county where the decedent lived (Probate Code §7051), so every Menifee estate is a Riverside County Superior Court case. Riverside County then splits probate work among three regional courthouses by ZIP code. Its administrative order, signed in December 2024 and effective December 23, 2024, applies to "all proceedings under the Probate Code," which covers conservatorships and trust petitions as well as estates. For Menifee the line falls inside the city. The Western Region list includes 92584 through 92586, so those estates are filed at the Riverside Historic Courthouse on Main Street in downtown Riverside. The Mid-County Region list includes 92587 and 92596, which go to the Southwest Justice Center on Auld Road in Murrieta. The third region, the desert, files in Palm Springs and does not reach Menifee.
How much of the city falls on each side? The Census Bureau's 2020 relationship file between ZIP code tabulation areas and cities puts about 92% of Menifee's land area in 92584, 92585 and 92586 (plus a sliver in 92570, which the order also assigns to Riverside). About 7.5% of the city's land lies in 92587 and less than 1% in 92596. The City's own address at 29844 Haun Road is a 92586 address. Land area is not the same as households, but for most of the city a probate is filed in downtown Riverside, while an estate from the 92587 part of the city is filed in Murrieta instead. Check the ZIP code on the decedent's last address before anyone files.
Both locations share the probate clerk's number, (951) 777-3147, and the court's web chat. The court disabled its probate webassistance email on May 19, 2025. The court's ex parte instructions give a 10:00 a.m. filing time at each probate location, with the hearing set at 10:00 a.m. the following day, and require a declaration of 24 hour notice to everyone entitled to it; the court says it strictly observes notice requirements. The court posts probate notes on its calendars, and a probate examiner will answer procedural questions about them by email but gives no legal advice. The court's page also links remote appearance phone numbers, an eSubmit portal, a probate mediation information sheet and its probate local rules.
Riverside County's first petition fee is $450, higher than the $435 most California counties charge, because the Judicial Council's fee schedule adds a local courthouse construction surcharge here. A trust changes the whole picture: the successor trustee you name manages and distributes trust property without opening a case at either courthouse, so the ZIP code question never comes up for that property.

Signing the trust is half the job. The house is covered only after a recorded deed moves it from you to you as trustee. Menifee has no recorder counter of its own, but the county lists two branch offices with Document Recording Services on either side of the city: Hemet to the east, on North State Street, and Temecula to the south, on County Center Drive. Both open at 8:00 a.m. and close at 4:30 p.m., half an hour before the two Riverside offices, and the county encourages booking an appointment. In person, the recorder takes credit or debit cards, cash, checks and money orders. County staff are not allowed to give legal advice or help prepare a deed, and the county recommends an attorney, title company or document preparation service.
Mail works as well. Regular mail goes to P.O. Box 751 in Riverside and overnight packages to the Gateway Drive office; the county asks you to allow six to eight weeks for the recorded original to come back. Checks are payable to the Riverside County Recorder, and if you are not certain of the total you may write "NTE" and a maximum amount on the memo line so the office fills in the correct figure. Do not count on a drop box near Menifee: the county's drop box list includes the two Riverside offices, Palm Desert and Blythe, does not list Hemet, and showed Temecula as temporarily unavailable when we checked. If you claim an SB 2 exemption, the county asks for its recorder cover sheet with the deed.
Two forms go with the deed. The Preliminary Change of Ownership Report tells the Assessor that you transferred the home to your own revocable trust; under Revenue and Taxation Code §62(d) that is not a change in ownership, so your Proposition 13 base year value stays where it is. The county's Documentary Transfer Tax Affidavit is required whenever a deed pays the tax or claims an exemption. The county tax is $0.55 for each $500 of value on a taxable conveyance, figured without liens already of record. The county's exemption pamphlet (ACR 177) lists, as its first item, conveyances to a revocable living trust by the grantor and from the trust to a beneficiary, so the county tax line on our deed reads $0.00 with the Revenue and Taxation Code §11930 statement.
Menifee also has a city share of the tax. The California City Finance table of transfer tax rates, effective December 1, 2025, lists Menifee as a general law city with a city rate of $0.55 per $1,000 and a county rate of $0.55, a total of $1.10 per $1,000. That total is the same $0.55 per $500 the county posts, split between county and city, not a second tax added on top. Menifee's ordinance taxes only realty sold, measured without any loan that stays on the property (Menifee Municipal Code §§3.22.010, 3.22.020), so a deed into your own revocable trust with nothing paid owes no city tax.

A law change is coming: from January 1, 2027, AB 2224 (Stats. 2026, ch. 292) sets the statutory base recording fee in Government Code §27361 at $15.00 for the first page and $4.00 for each additional page, and county program fees are still added on top, so Riverside County's posted totals will change next year. Probate Fees on a Typical Menifee Home
Zillow's Home Value Index gave a typical Menifee home value of $580,698 for August 2026 (research data through August 31, 2026), and the table runs the statutory fees on that number. Probate Code §10810 pays the estate's attorney a percentage of the gross estate: 4% of the first $100,000, 3% of the next $100,000 and 2% of the next $800,000. Probate Code §10800 pays the executor on the same schedule. Because the base is gross value, the fee does not shrink if the house still carries a mortgage.

Below the $750,000 petition limit, for now
Menifee's typical value sits about $169,000 under the $750,000 limit in Probate Code §13151, which for deaths on or after April 1, 2025 lets heirs ask the court to transfer a decedent's California primary residence without a full probate. Many Menifee families will qualify. The petition is still a court proceeding: it goes to the same regional courthouse a probate would, the Riverside County fee is $450, it cannot be filed until 40 days after the death, and each heir and devisee named in it must receive notice within five business days of filing. It covers only the home the decedent lived in, so a rental house or an empty lot needs another route. And it is measured by gross value at death, which can change.
Zillow's Menifee series shows how far values move. The typical value was $389,539 in December 2006, fell to $176,086 by February 2012, recovered to $318,385 by August 2016 and $504,297 by August 2021, and reached its high of $595,382 in January 2025. In August 2026 it was $580,698, a little below the $581,281 of a year earlier. A home that is comfortably under the limit today could be near it in a strong market, and a larger house in a newer tract may already be over it. A funded trust works the same at any value.
The small estate procedures are narrower still. For deaths on or after April 1, 2025, personal property can be collected by affidavit under Probate Code §13100 only if the estate totals $208,850 or less, and the affidavit for California real property of small value under Probate Code §13200 is limited to $69,625 and must wait six months after the death. A typical Menifee house is well above both.
Sun City, New Tracts and Park Homes: Menifee Details for Your Trust
A young city with an older core
Menifee voters approved cityhood on June 3, 2008, and the City was officially established on October 1, 2008, as Riverside County's 26th city. The City's 2024 to 2025 Annual Comprehensive Financial Report describes a general law city with a five member council and a council and manager form of government, covering more than 46 square miles. The Census Bureau estimates the population at 118,592 on July 1, 2025, up from a 2020 base of 102,526, a gain of about 15.7% in five years. The City's history page names the communities inside its limits: Sun City, Quail Valley and parts of Romoland, with the master planned Menifee Lakes community dating from 1989.
Sun City came first. The City's history page says development began in the 1960s with Sun City, an active retirement community planned by Del Webb, and that it remains centrally located in Menifee. The housing data SCAG prepared for Menifee's housing element in April 2021 still show that history. In the 2014 to 2018 survey figures, 18.3% of residents were 65 or older, compared with 13% in the SCAG region, and 9.5% of homes were built in the 1960s and 8.6% in the 1970s. Of 21,878 owner households, 7,757 were headed by someone 65 or older, about 35%. The age group where owners most outnumbered renters was 65 to 74.
An older homeowner's trust does two jobs. The first is avoiding probate at death. The second, which matters as much to a Sun City household, is what happens if the owner can no longer handle money or sign papers. Property held in a trust is managed by the successor trustee you choose, without a court case. Property left in your own name may require a conservatorship of the estate, and the court's where to file order sends that Probate Code proceeding to the same regional courthouse as a probate. A durable power of attorney covers accounts and items left outside the trust. A surviving spouse who inherited the house in his or her own name after the first death, by joint tenancy for example, is back to a probate at the second death unless the house is put into a trust.
Tract homes built after 2000
Most of Menifee is much newer. The Department of Finance estimate in SCAG's report counts 35,675 housing units, of which 30,552, or 85.6%, are detached single family houses; all single family homes together are 88.4%, against 61.7% in the region. In the survey data, 37.8% of homes were built from 2000 to 2009, and more owner households moved in from 2000 to 2009 (8,661) than in any other period. The state's estimates put Menifee's population at 77,519 in 2010 and 97,093 in 2020.
For a trust, a tract house is usually the easiest asset to fund: one parcel, one Assessor's Parcel Number and a legal description that refers to a lot on a recorded tract map. A detail on the county fee schedule follows from that. The $10.00 Survey Monument Preservation fee applies to deeds that do not describe a complete lot created by a recorded tract map, so a deed for a lot in a recorded tract does not pay it, while a deed for an older rural parcel described by metes and bounds may. If a couple holds title as joint tenants, that avoids probate at the first death only; a joint trust for a married couple, $500, handles both deaths with one set of documents.
CFD special taxes from several agencies
Many Menifee tracts pay community facilities district special taxes under the Mello-Roos Community Facilities Act of 1982. The City's CFD page says these special taxes are typically billed through the County of Riverside as separate line items on the property tax bill. It lists districts such as CFD 2012-1 Audie Murphy Ranch, CFD 2012-2 Hidden Hills, CFD 2014-1 Towne Center, CFD 2019-1 Meadow Run, CFD 2022-1 Quartz Ranch and CFD 2023-2 Cimarron Ridge, and explains that since April 2015 each new development annexes into a citywide maintenance district, CFD 2015-2, for street lighting, landscaping, road maintenance and street sweeping. The financial report adds detail on Audie Murphy Ranch: formed in January 2012, about 1,059.3 gross acres and roughly 2,129 homes at build out, with a maximum special tax that rises each July 1 with the Consumer Price Index, at least 2% and at most 6% a year.
The City is not the only agency with districts here. The financial report's table of overlapping debt lists community facilities district debt of the Menifee Union School District ($187,580,000), the Romoland School District ($200,355,000), the Eastern Municipal Water District ($81,250,000) and the City's own CFD Nos. 2016-2 and 2017-1 ($84,670,000), among others, as of June 30, 2025. A single Menifee tax bill can therefore carry more than one special tax line.
None of these change when the house goes into your trust. The special tax is levied on the parcel, so it stays on the bill, and your successor trustee keeps paying it from trust funds while the house is held, rented or sold. Put a recent tax bill with your trust papers so the trustee can see each line, and leave enough cash in the trust, or in an account payable to it, to cover the installments that come due while the estate is settled.
Mobile home parks and HCD titles
Menifee has an unusually large share of mobile homes. The state estimate in SCAG's report counts 2,589 mobile homes in 2020, 7.3% of the housing stock, compared with 3.5% across the SCAG region. The City's manufactured home page lists four parks with Menifee 92586 addresses: Sun Meadows on Murrieta Road, Bel Air Estates on Shadel Road, Hillside Mobile Home Estates on Murrieta Road and Sun City Mobile Home Estates on Sun City Boulevard. The City notes that homes inside a park fall under the sole authority of the state Department of Housing and Community Development, not the City.
A park home is funded differently from a house. HCD keeps the ownership records for the manufactured homes and mobilehomes it registers and updates them when ownership changes, so a home registered with HCD moves into your trust through an HCD transfer, not through a deed at the Hemet or Temecula recorder office. HCD also says that a home installed on a foundation system is no longer registered with it, so before choosing a method, find out whether your home still carries an HCD registration. Land you own separately is deeded to the trust at the recorder like any other parcel. Space rent is a separate matter from title: the City adopted Ordinance No. 2023-366, adding Chapter 5.80, Mobile Home Park Rent Stabilization, effective July 1, 2023, which limits the yearly space rent increase in covered parks to the lesser of 100% of CPI or 5%, once in any 12 month period. A successor trustee who will keep paying space rent for a time should have a copy of the lease and the park's contact information.
Flood and fire areas
Menifee sits in the lower part of the San Jacinto River basin. The safety element of the City's general plan says most local flooding comes from the San Jacinto River, Salt Creek and smaller drainages along the city's edges, including Ethanac Wash, the creek through Quail Valley, Paloma Wash and Warm Springs Creek, and that portions of Romoland remain a FEMA Special Flood Hazard Area, which the City describes as a regulated zone requiring the mandatory purchase of flood insurance. The fire hazards section says Cal Fire recommended a Moderate classification for the low lying urban areas, while the hillsides are generally Very High and the land between them High, and that state law requires fire hazard areas to be disclosed when property is sold. The City's fire maps page notes that the State Fire Marshal issued the 2025 recommended local responsibility area maps for Riverside County on March 24, 2025, and that owners in a Very High zone must keep 100 feet of defensible space.
These designations matter to a trust mainly at sale. When a successor trustee sells a Menifee house after your death, the trustee signs as seller and makes the disclosures. A trust that names a trustee who can reach the property, or authorizes the trustee to hire help, makes that sale smoother. While you are living, tell your homeowner's and flood insurers when the house moves into the trust and ask them to add the trust or trustee to the policy.
Schools, the college and your beneficiary forms
The City's financial report lists its principal employers as of June 30, 2025: Menifee Union School District (1,620 employees), Mt. San Jacinto College (1,309), Romoland Elementary School District (746), Target (450), Stater Bros (348), the City of Menifee (345), Texas Roadhouse (188) and Southern California Edison (185). Retirement plans, pensions and group life insurance from any employer pass by the beneficiary designation on file, outside both the trust and the pour-over will. Review each form when the trust is signed, and name a contingent beneficiary on each one.
Rentals and the next generation
A Menifee rental is treated differently from your residence in three ways. Its deed into the trust pays the $75 SB 2 fee, because the owner-occupier exemption does not apply. It cannot pass by a §13151 petition. And Proposition 19 does not protect its tax base when it goes to your children: the Board of Equalization explains that the parent-child exclusion is limited to a family home that was the parent's principal residence and becomes the child's, or a family farm, and that a rental home does not qualify. For a family home, the child must claim the homeowners' or disabled veterans' exemption within one year, and for transfers from February 16, 2025 through February 15, 2027, the exclusion covers the home's taxable value plus $1,044,586 of market value. At Menifee's typical value of $580,698, a family home that a child moves into stays within that limit. A trust does not change these tax rules, but it lets your successor trustee carry them out without a court order.

The Riverside County Superior Court's order on where to file probate documents, effective December 23, 2024, sends 92584, 92585 and 92586 to the Riverside Historic Courthouse, 4050 Main Street, Riverside, and sends 92587 and 92596 to the Southwest Justice Center, 30755-D Auld Road, Murrieta. Census Bureau ZIP code area data put about 92% of Menifee's land in the three ZIP codes assigned to Riverside. Both probate clerks answer at (951) 777-3147. Property held in a funded trust needs no filing in either building.
What would probate cost on a typical Menifee home?
Zillow's typical home value for Menifee was $580,698 for August 2026. In a full probate, Probate Code §10810 sets the attorney's statutory fee on that gross value at $14,613.96, and Probate Code §10800 allows the executor the same amount, for $29,227.92 together. Riverside County charges $450 for the first petition, and the probate referee's commission is about $581. A living trust costs $400 for one person or $500 for a married couple, and each deed is $100.
Our Menifee house is worth less than $750,000. Could our children use the primary residence petition instead of a trust?
Possibly, for a death on or after April 1, 2025, if the house was the decedent's primary residence and its gross value is $750,000 or less. Probate Code §13151 still requires a court petition, filed in the same regional courthouse a probate would use, with Riverside County's $450 fee. It cannot be filed until 40 days after the death, and each heir and devisee must get notice within five business days of filing. It does not reach a rental house or a vacant lot. A funded trust needs no petition.
