The courthouse most Garden Grove residents know is the Stephen K. Tamura West Justice Center at 8141 13th Street in Westminster. Garden Grove's row on the Orange County Superior Court's designation list does point to that building for some case types, but probate is not one of them. The list states that probate, mental health and elder and dependent adult abuse restraining order cases are heard at the Costa Mesa Justice Complex, and that applies to every city in the county. Family law goes to the Lamoreaux Justice Center in Orange, and a landlord's eviction case goes to the Central Justice Center in Santa Ana. So a Garden Grove family can deal with three or four different courthouses over the years, and the one that decides who gets the house after a death is in Costa Mesa.

Before a hearing, the court's probate examiners read the petition and supporting papers to check them against California law, the local rules and the publication and notice requirements. Their findings are posted as probate notes, which the parties can read online three to four weeks before the hearing. The notes list each deficiency and any document the judge still needs, and a probate research attorney helps the judge review the calendar. Every probate filing has to go through the court's e-filing system.

A funded trust takes the family out of that process. The successor trustee named in the trust document steps in when you die or can no longer handle your affairs, using the trust and a certified death certificate instead of letters from the court. Nothing is filed in Costa Mesa and no probate notes are written. Signing the trust does not move the house. The deed does. Until a trust transfer deed is recorded, title to your Garden Grove home stays in your individual name, and the house is headed for probate no matter what the trust says. The deed runs from you as owner to you as trustee and describes the parcel by its legal description and Assessor's Parcel Number. Garden Grove has no recorder's office of its own. The two closest counters that take real property recordings are the North County branch in Anaheim, in the Wells Fargo Building on Harbor Boulevard, and the main office on Ross Street in Santa Ana. The county asks most visitors to fill out a service application first, but not for a real property recording, and it accepts deeds by mail. The Clerk-Recorder posts its office locations list in English, Chinese, Korean, Spanish and Vietnamese.

The PCOR has a box for a transfer into a revocable trust. Revenue and Taxation Code §62(d) says that transfer is not a change in ownership, so the Orange County Assessor, at 500 S. Main Street in Orange (phone 714-834-2727), keeps your Proposition 13 base year value. The county's documentary transfer tax is $0.55 per $500 of value on a sale, and on a deed into your own revocable trust it is $0.00, with the Revenue and Taxation Code §11930 exemption stated on the deed. The current county fees are $12.00 and $3.00 a page; Assembly Bill 2224 (Stats. 2026, ch. 292) sets the statewide base recording fee at $15.00 for the first page and $4.00 for each additional page from January 1, 2027, and the county's 2027 totals were not yet posted when this page was checked.

Garden Grove's own transfer tax

Garden Grove is one of the cities with its own real property transfer tax, at 27.5 cents for each $500 of the price paid. Chapter 3.16 of the Municipal Code says it is adopted under Part 6.7 of Division 2 of the Revenue and Taxation Code, the state documentary transfer tax law (§3.16.010). Section 3.16.020 imposes it only on deeds of realty sold, and only when the consideration, not counting any lien or encumbrance that stays on the property, is more than $100. Section 3.16.050 has the County Recorder administer it under the same state law. A deed of your own home into your own revocable trust is not a sale and nobody pays a price, and your existing mortgage does not count as consideration under §3.16.020, so no city tax is owed on it. The tax matters later, when a trustee sells the house to a buyer.

Probate Fees Once a Home Passes $1,000,000

Zillow's Home Value Index put Garden Grove's typical home value at $1,007,401 for August 2026, up from $965,133 a year earlier; the index blends single family homes and condominiums. The figure first passed $1,000,000 in June 2026. Probate Code §10810 sets the attorney's statutory fee as a sliding percentage of the gross estate, and §10800 gives the executor the same schedule. Gross means the loan is ignored. Crossing $1,000,000 also moves part of the estate into the 1% tier, so the table below has four rows instead of three.

Every one of those ZIP code values is above $750,000, the limit for the primary residence petition under Probate Code §13151 for deaths on or after April 1, 2025, so that shortcut does not reach a typical Garden Grove house. Garden Grove Homes, Families and Your Trust

A city of large, married households

The 2020 Census counted 171,949 people in Garden Grove, and the Census Bureau's Vintage 2025 estimate puts the city at 170,455 as of July 1, 2025 (from a 2020 base of 171,976). The 2020 count found 47,362 households. Married couples headed 53.3% of them, and 54.0% of occupied homes were owned by the people living in them. The Bureau's American Community Survey for 2020 to 2024 puts the average household at 3.43 people. For a married couple who own the house together, one joint trust is usually the right structure: both spouses serve as trustees, the survivor keeps full control, and the house passes to the children without a probate after the second death. That is the $500 package.

Big households raise a question a single person's trust does not: who in the house has authority? An adult child who lives with you has no legal power over your property just by being there. If you want that child to handle the house when you cannot, name the child as successor trustee in the trust and as agent in the durable power of attorney. If two or three children live under the same roof, decide in the trust who acts, whether they act together, and whether a child living in the house may stay there for a time after your death.

Single family homes and Proposition 19

The California Department of Finance figures in the city's 2021 to 2029 Housing Element count 27,680 detached single family homes in Garden Grove, 57.1% of all units. If your family has owned its house for decades, it carries a low Proposition 13 base year value, and that is where Proposition 19 bites. A trust avoids probate; it does not keep the parent's tax base for the children. A child keeps it only by moving in as a principal residence and filing for the homeowners' exemption within one year, and only up to the parent's taxable value plus $1,044,586 for transfers from February 16, 2025 to February 15, 2027.

A hypothetical shows how that works here. A parent's factored base year value is $120,000. Add $1,044,586 and the limit is $1,164,586, which is more than Zillow's typical Garden Grove value of $1,007,401, so a child who moves in keeps the $120,000 base. If the child keeps the house as a rental instead, the county reassesses it at market value. For households where an adult child already lives in the home, that rule is worth talking through before you choose a successor trustee and decide who receives the house.

Mobile homes and condominiums

The Housing Element counts 1,628 mobile homes in Garden Grove, 3.4% of the housing stock, and the city permits mobile home parks in its R-3 zone. A manufactured home on a rented park space is usually titled with the state Department of Housing and Community Development, not recorded with the county, so a trust transfer deed does nothing for it. HCD's instructions for changing ownership into a trust call for the original Certificate of Title signed by every owner, the registration card, the Multi-Purpose Transfer Form signed by each trustee and a $35 transfer fee. A home on the local property tax roll, with a decal number that starts with L, also needs a tax clearance certificate from the Orange County Tax Collector. A home on yearly registration, with an A decal, may owe renewal fees if the registration expires within 60 days. If the park home is left out of the trust, it can end up as the one asset that needs a court or HCD procedure after your death.

Condominiums and townhomes are deeded like a house. The Housing Element lists 4,087 single family attached homes and 10,858 units in buildings of five or more. One trust transfer deed covers your unit and its share of the common area. Send the homeowners association a copy of the recorded deed so its records and billing show the trust.

Families who read Vietnamese, Korean or Spanish first

The city did its Housing Element outreach in English, Spanish, Vietnamese and Korean, and the census numbers show why. The Census Bureau's American Community Survey for 2020 to 2024 estimates that 46.2% of Garden Grove residents were born abroad, that 37.7% of people aged five or older spoke an Asian or Pacific Island language at home and that 28.4% spoke Spanish. That has three practical effects on a trust. First, the signing: the Secretary of State's 2026 Notary Public Handbook says a notary must be able to communicate with the signer and should not use an interpreter, and it tells notaries to refer the signer to a notary who speaks the signer's language. Find that notary before you schedule the signing.

Second, the successor trustee. A child who lives in Seoul or Ho Chi Minh City can serve, but every bank form, escrow paper and deed would have to be signed from abroad. Many families name a child or relative in Southern California first and the overseas child second. Third, property outside the United States. A California trust transfer deed records only in a California county. Land or an apartment in another country follows that country's law, and the trust may not be able to hold it, so ask a lawyer there how to leave it.

When the first trustee dies

On the title records, your house stays in your name as trustee after you die until someone records proof of the death. Probate Code §210 lets any person record, in the county where the property sits, an affidavit of death that describes the property and attaches a certified copy of the death record. Your successor trustee records that affidavit with the Orange County Clerk-Recorder, then signs as trustee to sell the house or deed it to the beneficiaries. The Orange County Clerk-Recorder's fee for a certified copy of a death certificate is $26.00, and it is worth ordering several copies, because banks and brokerage firms each want their own.
