A probate for a Visalia resident begins at the Civil Legal Filings counter in Room 201 of the County Civic Center. The court's probate page says that filing a petition with the Legal Filings Department starts the proceeding, and it names a second filing counter at the South County Justice Center in Porterville. The same probate department handles decedents' estates, trusts, guardianships of minors and conservatorships of adults, so a family opening an estate shares the calendar with every other kind of probate matter in the county.
The court accepts electronic filing in probate cases through an approved electronic filing service provider. It also publishes probate examiner recommendations on its Tentative Rulings page, and it tries to post them by 3:00 p.m. the day before the hearing. Each matter is marked recommended for approval or appearance required, often with a numbered list of what is missing: a notice of hearing that was not served on time, an account whose charges and credits do not balance, a schedule that was never attached. Every one of those notes means another hearing date. A trust that holds the house never appears on that list.
The court's probate page also lists the probate referee for the county, with an office in Hanford in neighboring Kings County. In a probate the referee appraises the non-cash assets and is paid one-tenth of one percent of their value under Probate Code §8961. The deed involves no sale, so the documentary transfer tax due is $0.00: Revenue and Taxation Code §11930 exempts a deed that transfers realty by gift outright to, or in trust for the benefit of, any person, and the deed cites that section next to the tax line. File the PCOR with the deed and the Assessor has what it needs to apply §62(d).
The county now asks for more on the face of a deed. Its Document Recording Requirements page says the Assessor's Parcel Number must appear on all deeds, quitclaim deeds and deeds of trust, and its Recording a Document page says that from January 1, 2027 a deed without an APN will not be processed until the number is added. That rule supports SB 255, under which the recorder must mail the owner a notice within 30 days after a deed, quitclaim deed, deed of trust or mortgage is recorded. Expect that letter after your trust deed records; it is the county confirming the filing, not a problem with it.
You can record in person at the South Mooney Boulevard office, which takes cash, check and credit cards, or by mail with a check or money order payable to Tulare County Assessor/Clerk-Recorder. Electronic recording is limited to authorized submitters such as title companies and lenders. The survey monument fee is easy to miss: a lot in a recorded tract map is excluded, but a rural parcel that is not a tract map lot is not, so a trust deed for ranch land can cost $10 more than one for a subdivision home. One date to watch: AB 2224 (Stats. 2026, ch. 292) rewrites Government Code §27361 so that from January 1, 2027 the base recording fee is $15.00 for the first page and $4.00 for each additional page, up from $10.00 and $3.00. The county's add-on fees sit on top of that base, so check the Recorder's schedule for the new totals if you record after New Year's Day.
Zillow's Home Value Index put the typical Visalia home at $397,626 with data through August 31, 2026, up 1.5% over the year. The fee math uses Zillow's typical home value (Zillow research data, August 31, 2026), which tracks the whole housing stock rather than one month of sales. Probate Code §10810 sets the attorney's statutory fee at 4% of the first $100,000 of the estate, 3% of the next $100,000 and 2% of the next $800,000, figured on the gross value with no deduction for the mortgage. Probate Code §10800 gives the executor the same amount again.

Two shortcuts matter for Visalia values. The small estate affidavit is limited to $208,850 for deaths on or after April 1, 2025, and the typical Visalia home alone is nearly twice that. A county seat of working families
Visalia counted 141,384 residents in the 2020 Census and serves as the county seat of Tulare County. The city is usually described by area: Downtown Visalia, North Visalia, the Eastside, Southwest Visalia, the Industrial Area, Mooney and the Westside. The 2020 Census found 46,561 households, 48.9% of them married couples and 41.1% with children under 18. That mix shapes the plan. Married homeowners usually choose one joint trust for $500, and parents of minors need a trust that holds a child's share until an age they pick instead of handing it over at 18. The package also includes a durable power of attorney and an advance health care directive, which do the work a conservatorship petition in the same probate department would otherwise do.
Farmland, dairies and Williamson Act parcels
If you own an orchard, vineyard, dairy or pasture parcel along with the house, it may be under a Williamson Act contract, a voluntary agreement with the county that keeps the land in agricultural use in exchange for a lower assessment. The county generally requires each parcel in a contract to have at least 10 acres of prime irrigated land or 40 acres of non-prime land, and a new agricultural preserve generally needs 20 acres of adjoining land.
A trust works well with contracted land. Government Code §51243 makes the contract binding on all successors in interest of the owner, so the deed into your trust carries the contract and the preferential assessment with it, and your successor trustee later steps into your place with the same right to give notice of nonrenewal or seek cancellation. Each parcel needs its own deed with its own APN. Livestock, equipment and crop inventory are personal property, covered by the assignment of personal property in the package, and an interest in a farming LLC or partnership is assigned to the trust under that entity's own agreement.
Hospital, county and school pensions
The City of Visalia's 2025 financial report lists Kaweah Delta Healthcare as the largest employer in the city, followed by Tulare County, the Visalia Unified School District, the Amazon fulfillment centers, the City of Visalia, Walmart, the College of the Sequoias, VF Outdoor Distribution and California Dairies Inc. Many of those jobs come with a pension or a 403(b) or 457 plan, and none of that money passes under your trust. It passes to whoever is named on the plan's beneficiary form. Tulare County employees in TCERA, for example, name beneficiaries on TCERA's own form, which must be witnessed and signed by someone who is not named as a beneficiary. Update those forms when you sign the trust, and name either the people you intend or the trust itself when a minor or a family member who cannot manage money is in the picture.
Creeks, flood maps and insurance
Mill Creek and Packwood Creek run through the city, and the City of Visalia publishes flood information built on the FEMA flood maps that took effect June 16, 2009, with a flood map assistance line at 559-713-4640. A trust does not change your flood zone, but it changes who owns the house. After the deed records, give the trust name to your homeowners insurer and to any National Flood Insurance Program carrier so the policy covers you as trustee and covers your successor trustee after a death. If your lender asks about the transfer, the certification of trust shows who the trustee is without disclosing the whole document.
Three Rivers cabins and land across the county line
Three Rivers, the foothill community on Highway 198 near the entrance to Sequoia National Park, is in Tulare County, so a cabin there is deeded to your trust through the same Recorder's Office on South Mooney Boulevard as your Visalia home. Tulare County borders Fresno County to the north, Kern County to the south, Kings County to the west and Inyo County to the east, so a Visalia family may also own a rental in Hanford, the Kings County seat, or land in Fresno or Kern. The county's own recording rules say property recorded there must be located in Tulare County, so each out-of-county parcel is deeded through that county's recorder, with that county's fees and PCOR. One trust still holds everything. Leaving the out-of-county parcel untitled is the common mistake that sends a family to probate in a second county.
What your trustee files after a death
The trust avoids probate, but it does not avoid the Assessor. Revenue and Taxation Code §480 requires the trustee to file a change in ownership statement within 150 days after the date of death when property passes through a trust. The Tulare County Assessor says the Death of Real Property Owner form (BOE-502-D) is required even when the property was held in a trust, and it asks for the death certificate and the entire trust, including all amendments. If the filing is late after a written request, the penalty is $100 or 10% of the taxes on the new value, whichever is greater, capped at $5,000 for a home with the homeowners' exemption and $20,000 for other property when the failure was unintentional. Whether a child keeps the parent's assessed value is a separate question under Proposition 19, which generally requires the child to live in the home.
