The court kept the same Zoom link for probate hearings after the move to Lodi
Tracy has about 100,000 residents, but no court sits there. The Superior Court's own locations page names four places where it does business: the Stockton Courthouse, the Juvenile Justice Center in French Camp, and branch courts in Manteca and Lodi. Probate is in the last of these. On Monday, February 3, 2025, probate left Stockton for Department L2 of the Lodi courthouse at 315 W. Elm Street, and that is where a petition for a Tracy estate is filed and heard today. The rule that decides the county is Probate Code §7051: an estate is administered in the county where the person was domiciled at death, wherever the death happened. A Tracy resident who dies in a hospital in Alameda County still has a San Joaquin County probate.
The court's probate page explains how a case moves once it is filed. Probate examiners review all documents for legal sufficiency before matters are heard, which is meant to reduce the time a judge spends at the hearing. When we checked it in October 2026, that page also asked filers whose hearing falls within 30 days to bring their papers to the courthouse instead of e-filing them, since electronic probate filings were slow to be processed. The drop box is open the same hours as the phone line. Separately, Probate Code §8200 requires whoever has the original will to deliver it to the clerk within 30 days after learning of the death, unless a petition to probate it has already been filed.
A funded trust takes all of this off the table for the house. The successor trustee you name signs for the trust under the authority the trust document gives, so there is no petition in Lodi, no examiner's review, no Zoom calendar and no public file listing your Tracy address and the names of your children.

A signed trust owns nothing until property is put into it, and for a house that takes a recorded deed. Our deed conveys the Tracy lot from you, the owner, to you as trustee, identifying it by the legal description and parcel number on your current vesting deed, and you record it with the San Joaquin County Recorder. For Tracy owners there is a closer choice than downtown Stockton: the county's Recorder-County Clerk satellite office at Lathrop City Hall lists document recording among its services, along with copies of recorded deeds. It does not record maps or take filed documents, and it is open only on Wednesdays and Thursdays, 8:00 a.m. to 3:30 p.m., so check the county's page before you go. It takes credit cards, with a $2.50 transaction fee, checks and cashier's checks; it lists no cash. The Stockton office also takes deeds by mail.
The fee schedule has three first page lines. A document exempt from SB 2 pays $16.00, raised from $14.00 on July 1, 2025. A document that owes the $75 SB 2 fee pays $91.00. The $99.00 line adds an $8.00 fraud fee that the schedule charges on a list of document types that includes quitclaim deeds, gift deeds and deeds of trust. A trust transfer deed is not on that list, and neither is a grant deed; Government Code §27388(a) names the documents that carry the fraud fee. Our deed of the home you live in claims the owner-occupier exemption in Government Code §27388.1(a)(2) on its face, so the $75 SB 2 fee is usually not charged on it. A rental, a second home or vacant land pays it, capped at $225 per transaction. How a recorder handles any given deed is its own call, and no county promises the result in advance.
When a deed claims an exemption from documentary transfer tax, San Joaquin County wants paperwork beyond the deed itself. Its documentary transfer tax page says the exemption must be stated on the document and an exemption form completed and submitted at the time of recording. The county's Affidavit of Exemption from Documentary Transfer Tax must be completed in full and filed with the deed, and item 6 on that form covers a deed to or from a trust for the benefit of the grantor and trustee named in it, with the warning that a copy of the trust may be required for viewing. The county's page states the rule plainly: a deed that transfers the grantor's interest to or from a revocable trust for the grantor's benefit is exempt from transfer tax. The county tax is $0.55 for each $500 of value on a taxable deed.
Tracy's own transfer tax
Tracy has a city tax as well, the Real Property Transfer Tax Law of the City of Tracy in Article 5 of Chapter 8.08 of the Municipal Code. Section 8.08.450 says it is adopted under Part 6.7 of Division 2 of the Revenue and Taxation Code, the state documentary transfer tax law. Section 8.08.460 imposes 27.5 cents for each $500 on a deed by which realty "sold within the City" is conveyed, measured by the consideration or value "exclusive of the value of any lien or encumbrances remaining thereon at the time of sale," and only when that amount exceeds $100. Section 8.08.530 has the County Recorder administer it under Part 6.7. California City Finance's rate table, effective December 1, 2025, lists Tracy as a general law city with a city rate of $0.55 and a county rate of $0.55 per $1,000, $1.10 in all. Putting your own home into your own revocable trust is not a sale, nothing is paid, and the city measure leaves out the mortgage that stays on the house, so no Tracy tax is due on that deed. A sale by your trustee after your death is taxed like any other sale.
The mortgage stays where it is
The Census Bureau's 2020 to 2024 American Community Survey estimates that 14,756 of Tracy's 18,786 owner-occupied homes, 78.5 percent, carry a mortgage, so the question of the loan comes up in most Tracy households. Federal law answers it. Under 12 U.S.C. §1701j-3(d)(8), on a home of fewer than five dwelling units a lender may not exercise a due-on-sale clause because of a transfer into an inter vivos trust in which the borrower is and remains a beneficiary and which does not relate to a transfer of rights of occupancy. The loan stays in your name, and you keep making the same payments.
On the Preliminary Change of Ownership Report you check the box for a transfer into a revocable trust. Revenue and Taxation Code §62(d) says that transfer is not a change in ownership, and the San Joaquin County Assessor's page says a transfer by the trustor into a revocable trust is generally excluded from reassessment, so your Proposition 13 base year value stays. Recording fees change statewide on January 1, 2027, when AB 2224 (Stats. 2026, ch. 292) sets the Government Code §27361 base fee at $15.00 for the first page and $4.00 for each additional page; county add-on fees are charged on top, so San Joaquin County's posted totals will change. What Probate Would Cost on a Typical Tracy Home
Zillow's Home Value Index put the typical Tracy home value at $672,627 for August 2026 (Zillow research data through August 31, 2026), down from $703,725 a year earlier. That figure drives the table. Probate Code §10810 pays the estate's attorney a percentage of the gross estate: 4% of the first $100,000, 3% of the next $100,000 and 2% of the next $800,000. Probate Code §10800 gives the executor the same amount again. Both are figured on gross value, so the mortgage most Tracy owners carry does not lower either fee.
Court filing fee: $435 for the first petition under the statewide civil fee schedule effective January 1, 2026. San Joaquin County is not one of the counties the schedule marks for a different total.
Probate referee: one-tenth of one percent of the property the referee appraises (Probate Code §8961), about $673 on this home.
Creditor period: creditors have until four months after letters issue to file claims (Probate Code §9100), so no estate can close sooner.

Tracy and the $750,000 line
For deaths on or after April 1, 2025, Probate Code §13151 lets heirs ask the court to transfer the decedent's primary residence without a full probate if its gross value is $750,000 or less. That limit matters more in Tracy than in most of the county, because Tracy values sit close to it. Zillow's monthly series for the city shows the typical value at $221,636 in January 2000, $531,686 in August 2006, and $211,368 in December 2011, the low point after the housing crash. It rose to $408,490 by August 2016 and $665,717 by August 2021, then stayed above $750,000 for six months, April through September 2022, peaking at $782,793 in June 2022. It was $731,920 in August 2024, $703,725 in August 2025 and $672,627 in August 2026.
The typical figure also hides the spread. In the Census Bureau's 2020 to 2024 survey, owners put 74.4 percent of Tracy's owner-occupied homes between $500,000 and $999,999 and 9.9 percent, about 1,862 homes, at $1,000,000 or more; the median owner estimate was $699,000. A larger house in Tracy can be over the limit today, and an average one can cross it in a strong year. Even under the limit, the §13151 petition is a court case in Lodi: a $435 filing fee, notice to the heirs and a hearing. It reaches only the home the person lived in, not a rental. The smaller shortcuts do not fit Tracy houses at all: the Probate Code §13200 affidavit stops at $69,625 of California real estate for deaths on or after April 1, 2025, and the Probate Code §13100 personal property affidavit at $208,850. A deed into a trust works the same whatever the house is worth on the day you die.
Tracy Households, Commutes and Your Trust
A city of married owners with children at home
The Census Bureau estimates Tracy's population at 101,901 on July 1, 2025, up from a 2020 base of 93,146. The 2020 to 2024 American Community Survey counts 30,228 housing units, 81.0 percent of them detached single family houses, and about 252 mobile homes. Of 28,920 occupied homes, 65.0 percent are owner occupied. The same survey estimates that 59.8 percent of Tracy households are married couples, that 43.7 percent include someone under 18, and that 27.1 percent include someone 65 or older; the average household has 3.34 people.
Those numbers point to the documents most Tracy families need. A married couple who own their home together usually sign one joint trust, at $500, so the house stays in the trust when the first spouse dies and passes without court when the second does. Parents of minor children can nominate a guardian in the pour-over will and have the trust hold a child's share until an age they choose, rather than leaving a teenager to receive an inheritance outright at 18. In a household with a grandparent at home, the durable power of attorney and the advance health care directive let the person you choose handle money and medical decisions if illness comes first.
Newer subdivisions and special taxes
Most of Tracy's housing was built after 1980. The survey dates 25.9 percent of units to 2000 through 2009, 22.2 percent to the 1990s and 15.4 percent to the 1980s, and 12.8 percent to 2010 or later. Newer neighborhoods often come with special taxes. Article 7 of Chapter 8.08 of the Tracy Municipal Code, added by Ordinance No. 1250 in March 2018, levies a special tax within a community facilities district for its services starting in fiscal year 2018 to 2019, collected on the San Joaquin County secured tax roll in the same manner as ordinary property taxes and with the same lien priority. A trust does not change a special tax: it stays on the parcel and keeps appearing on the bill your successor trustee pays. What the trust does is put someone with authority in place to pay that bill, and the property tax installments, without waiting for a court to appoint an executor. Keep the most recent tax bill with your trust papers so your trustee can see every line on it.
Tracy's code also provides for active adult communities. Chapter 10.18 sets up a ballot process for active adult residential allotments, and a property that uses them must limit occupancy, by deed restriction or another enforceable means, to people who qualify under Civil Code §§51.2 through 51.4 and related fair housing law. If you live in an age restricted home, the restriction stays with the house after it moves into your trust. A child who inherits it may not qualify to live there, so the trust should give your successor trustee clear power to sell it or hold it for the beneficiaries.
Working outside San Joaquin County
Many Tracy residents earn their living elsewhere. The Census Bureau's 2020 to 2024 commuting table estimates that 43.0 percent of Tracy workers work in a California county other than San Joaquin, and the mean travel time to work is 42.5 minutes; 14.7 percent work from home. That matters for a trust in two ways. First, a 401(k), 403(b) or 457 plan, a pension and group life insurance from an employer anywhere pass by the beneficiary form on file with that plan, not by your trust or your will, so we go through each designation with you. Second, if you also own a condominium or rental in another county, its deed is recorded with that county's recorder, under that county's fees and, inside some cities, that city's own transfer tax rules. California City Finance's table shows how different those can be next door: Livermore, Pleasanton and Fremont are general law cities at $0.55 per $1,000, while Hayward is a charter city at $8.50 per $1,000. We look at each parcel's county and city separately. Property left out of the trust can still end up in a probate in Lodi.
When the house sits empty
Tracy replaced its rules on vacant buildings in March 2026 (Ordinance No. 1384, which enacted a new Chapter 9.24 of the Municipal Code). Section 9.24.140 makes property owners responsible for registering every vacant building with the City's Community and Economic Development Department within 30 days of the vacancy, and says no building designed for occupancy may stand vacant for more than 30 days unless an exception applies, for example a building that meets all codes and is in the active, legitimate process of being leased or sold, or one the director finds the owner is actively maintaining and monitoring. The chapter's security standards require a vacant structure to be secured from unauthorized entry. It defines the owner as the person listed on the last equalized county tax roll, or a person the owner designates who is in charge or control of the vacant building.
After a death, a house in Tracy is often empty while the family decides what to do. In a probate, nobody has authority over it until the court in Lodi issues letters. In a trust, the successor trustee you named can act from the day of death: register the vacancy, keep the house secured and maintained, list it for sale or lease it, and pay the bills from trust funds.
Farms at the edge of town
Chapter 10.24 of the Municipal Code, the City's right to farm law, states a policy of protecting existing agricultural operations within the city and declares that a commercial farm operated properly for more than three years does not become a nuisance because of changed conditions around it. If you own a farm parcel as well as your house, it goes into the trust by its own deed and PCOR, recorded in Stockton or Lathrop like the house, and the trust should say who will run or lease it if you cannot.
Passing the house to your children
The trust decides who receives the house; property tax law decides what the new owner pays. Under Proposition 19, as the State Board of Equalization explains it, a child who makes the family home a principal residence keeps the parent's factored base year value if the home's market value does not exceed that value plus $1,044,586 (for transfers from February 16, 2025 to February 15, 2027); any excess is added to the assessment. A Tracy rental, or a home no child will live in, is reassessed. The San Joaquin County Assessor notes that a reassessment after a change in ownership may produce a supplemental bill, so the trustee should plan for it before the house is distributed or sold.
