A signed trust holds nothing until assets are put in it. For a Carlsbad house that means a deed from you as owner to you as trustee of your trust, recorded with the San Diego County Recorder. The county's recording page lists its requirements: the Assessor's Parcel Number must appear on every deed under local ordinance (R&T §11911.1), the top two and a half inches of the first page are left blank for the Recorder's stamp, the signature must be original and acknowledged by a notary, and the deed must say where the recorded original goes back to. You can record in person at four county offices without an appointment. From Carlsbad the closest is the San Marcos office on Carmel Street. A deed can also be mailed with a check: express and overnight packages go to 590 3rd Avenue, Suite 204, Chula Vista, CA 91910, and ordinary mail to P.O. Box 121750, San Diego, CA 92112-1750.
The fee schedule separates documents that carry the $10 real estate fraud fee from those that do not. Government Code §27388(a)(1) lists the documents that carry it, and the county's schedule names deeds of trust, reconveyances and notices of default among those titles, at $17.00 for the first page. A grant deed or trust transfer deed is not on that list, so the county's first page charge for it is $14.00, plus $3.00 for each additional page. Paying by card at the counter adds a $2.50 surcharge.
The $75 SB 2 fee is usually not charged on a deed moving your own home into your trust, because the owner-occupier exemption of Government Code §27388.1(a)(2) is claimed on the face of our deed. It is charged on rentals, second homes and vacant land, up to $225 per transaction. The Preliminary Change of Ownership Report that goes with the deed has a box for a transfer into a revocable trust, and under Revenue and Taxation Code §62(d) that transfer is not a change in ownership, so the Assessor keeps your Proposition 13 base year value and no supplemental bill follows. San Diego County's documentary transfer tax is $0.55 per $500 of value on a sale. The county documentary transfer tax is $0.00 on a transfer into the grantor's own revocable trust (R&T §11930), and the Recorder asks for "0" on the tax line and an exemption statement on the face of the document. Carlsbad became a charter city in 2008, and CaliforniaCityFinance.com's December 2025 rate table lists a Carlsbad city rate of $0.55 per $1,000 and a county rate of $0.55 per $1,000, a total of $1.10 per $1,000, which is the same as the county's $0.55 per $500. A transfer into your own revocable trust usually pays no transfer tax because no price is paid; the deed states the exemption. Confirm with the county recorder.
Our office prepares the deed and the PCOR for $100 per property; you sign the deed before a notary and record it in San Marcos, at another county office, or by mail. One change is coming: AB 2224 (Stats. 2026, ch. 292) sets the Government Code §27361 base recording fee at $15.00 for the first page and $4.00 for each additional page from January 1, 2027. What Probate Would Cost on a Typical Carlsbad Home
For the figures below we use Zillow's Home Value Index for Carlsbad: a typical home value of $1,593,241 for August 2026 (Zillow research data through August 31, 2026, all homes, smoothed and seasonally adjusted). Probate Code §10810 pays the estate's attorney a percentage of the gross value of the estate: 4% of the first $100,000, 3% of the next $100,000, 2% of the next $800,000 and 1% of the next $9 million. Probate Code §10800 gives the executor the same amount. Because the base is gross value, a Carlsbad house bought decades ago and owned free and clear produces the same fee as one carrying a new jumbo loan.

Carlsbad's spread runs higher than the citywide figure. In the Zillow Home Value Index (research data), August 31, 2026, La Costa Ridge was at $2,290,969; on that value the same schedule gives $35,909.69 to each side, $71,819.38 together. Even Calavera Hills, the lowest Carlsbad neighborhood in that data at $1,135,400, produces $24,354.00 per side, or $48,708.00. Our California probate fees guide explains each charge.
The simplified routes do not help much here. The small estate affidavit under Probate Code §13100 is limited to $208,850 for deaths on or after April 1, 2025, and no Carlsbad house comes close. The Probate Code §13151 petition for a primary residence reaches $750,000 for deaths on or after April 1, 2025, which is below every Carlsbad neighborhood value Zillow reported for August 2026. Against those numbers, the trust is $400 for one person or $500 for a married couple, plus $100 for the deed.
Carlsbad Property Facts That Shape Your Trust
Four quadrants, one price range: high
The Census Bureau estimated Carlsbad's population at 112,260 on July 1, 2025, down from a 2020 base of 114,732. The city was incorporated on July 16, 1952, and for planning purposes it is divided into four quadrants, each with its own ZIP code. The northwest quadrant (92008) holds the Village, the Barrio and Olde Carlsbad, with cottages and ranch houses from the 1950s and 1960s near the Buena Vista and Agua Hedionda lagoons. The northeast quadrant (92010) is mostly single family homes in Calavera Hills and Chestnut Hills. The southeast (92009) has the master-planned communities of Bressi Ranch and the La Costa neighborhoods, and the southwest (92011) runs along the ocean and includes Aviara.
Zillow's neighborhood data shows how much those areas differ. In the Zillow Home Value Index (research data), August 31, 2026, Calavera Hills was at $1,135,400, City Center at $1,143,567, Rancho Carlsbad/Sunny Creek at $1,152,586 and Tamarack Point at $1,270,064. The Barrio was at $1,350,065, Poinsettia at $1,372,810, Rancho La Costa at $1,385,182 and Rancho Carrillo at $1,441,014. The Village was at $1,667,122 and Olde Carlsbad at $1,682,964. Bressi Ranch ($1,805,705), Robertson Ranch ($1,840,252), South Beach ($1,857,681) and Aviara ($1,984,074) were higher still, and La Costa Oaks ($2,064,591), La Costa Greens ($2,102,395) and La Costa Ridge ($2,290,969) topped the list. Every one of them is above the $750,000 line for the home petition. For a Carlsbad owner the realistic choice is a funded trust or a full probate.
Proposition 19 at Carlsbad prices
An owner who bought in Carlsbad decades ago may pay tax on a base year value far below today's market. A trust does not pass that low value to the children by itself. The trust controls who inherits; Proposition 19 controls the tax. A child keeps the parent's base only for a family home that becomes the child's principal residence, with a homeowners' exemption claim filed within one year, and only up to the factored base year value plus $1,044,586 for transfers from February 16, 2025 to February 15, 2027. Value above that limit is added to the taxable value.
Here is a hypothetical. A parent's factored base year value is $400,000 and the home is worth the typical $1,593,241 at death. The limit is $400,000 plus $1,044,586, or $1,444,586. The home is worth $148,655 more than that, so the child's new taxable value would be $548,655 even if the child moves in. If no child moves in, the home is reassessed to market value, and a Carlsbad rental or second home is reassessed when it passes to children. Knowing this before you sign helps you decide whether the trust should let the trustee sell, give one child the option to buy out the others, or hold the house for a child who will live in it. Master-planned communities and Mello-Roos districts
Much of the southeast quadrant was built as master-planned communities, and a home in one of them may belong to a homeowners association and sit inside a Community Facilities District. The San Diego County Auditor and Controller's list of active Mello-Roos districts for fiscal year 2025-2026 names Carlsbad CFD #1, CFD #3 Faraday/Melrose (Areas 1 and 2), and Carlsbad Unified School District CFDs #1, #3, #4 and #5, each with an administrator's phone number for payoff questions. These charges belong to the parcel, not to the owner. Recording a deed into your own trust does not end a special tax or trigger a new one, and the successor trustee keeps paying it with the property tax installments. When the deed records, send a copy to the HOA so the association's records show the trust, and keep the CFD details with your trust papers so the trustee knows what is owed if the house is sold.
The 2014 Poinsettia Fire and where your papers are
On May 14, 2014 the Poinsettia Fire broke out near Poinsettia Lane and Alicante Road in Carlsbad, just east of El Camino Real, and residents nearby were ordered to evacuate their homes. KPBS reported the next day that 18 apartments were destroyed, eight single family homes were destroyed or severely damaged and two businesses were lost, with damage estimated at $22.5 million. A trust cannot lower a fire risk or an insurance premium. What it can do is make sure someone has authority to act. If you are hurt or unable to manage your affairs after a disaster, your successor trustee can deal with the insurer and rebuild or sell a trust-owned home without a conservatorship, and the durable power of attorney covers assets outside the trust. After the deed records, ask your insurance agent to show the trust, or you as trustee, on the homeowners policy, and keep a copy of the signed trust and the recorded deed somewhere you could take with you in an evacuation.
The city's three lagoons, Buena Vista, Agua Hedionda and Batiquitos, also mean some parcels sit near water. FEMA's Flood Map Service Center lets you look up your own address; a trust does not change the flood zone, but the trustee will need the policy in the right name to make a claim.
Large employers, stock plans and retirement accounts
The Carlsbad Chamber of Commerce lists the city's top employers, among them Viasat, Thermo Fisher Scientific, Legoland California, Carlsbad Unified School District, Omni La Costa Resort and Spa, the Gemological Institute of America, the City of Carlsbad and Ionis Pharmaceuticals. If you work for one of them, you may hold a 401(k), a pension or an employer stock plan account. Retirement plans and life insurance pass by beneficiary designation, not by your trust, so those forms need checking when you sign. Vested shares sitting in an ordinary brokerage account are different: that account can be retitled to the trust or set to transfer to it on death, which keeps it out of probate too.
Owner Alert: watching the title after your deed records
The San Diego County Recorder runs a free service called Owner Alert, which emails subscribers whenever a document is recorded under a registered name or Assessor's Parcel Number. The county's page says a property held in a trust can be registered, using the trust's name, the names of the trustees and, optionally, the parcel number, and that the registration should be updated if the trust name or trustees change. For a Carlsbad home worth well over a million dollars, a few minutes of signup after the trust deed records is worth it.
When a Carlsbad owner dies: the Assessor's form
The trust replaces the court, not the county. The San Diego County Assessor requires a Change in Ownership Statement, Death of Real Property Owner (BOE-502-D), within 150 days of the death, and says the form is required even when the deceased person held the property in a trust; a late or missing filing can bring a penalty. Most successor trustees also record an affidavit of death of trustee, attaching a certified death certificate. The Recorder posts an affidavit of death of trustee among its courtesy forms, and its fee schedule lists a death certificate at $26.00.

Is probate for a Carlsbad estate heard in North County?
No. Probate in San Diego County is heard at the Central Courthouse, 1100 Union St., San Diego, CA 92101, with the Probate Business Office on the third floor. The North County Regional Center in Vista, the nearest court building to Carlsbad, has only a probate drop box, and the court asks that mail go to the Central Courthouse. Every hearing on a Carlsbad estate, from the first petition to the final accounting, is held downtown. A Carlsbad home that was deeded into a living trust does not go through that court at all.
What would probate cost on a typical Carlsbad home?
Zillow's typical home value for Carlsbad was $1,593,241 for August 2026. Probate Code §10810 sets the statutory attorney fee on that gross value at $28,932.41, and Probate Code §10800 allows the executor the same amount, for $57,864.82 together. A mortgage does not reduce either figure. The $435 first petition filing fee and a probate referee commission of about $1,593 are added. A living trust is $400 for one person or $500 for a married couple, and the deed is $100.

My Carlsbad home pays Mello-Roos special taxes. Does putting it in a trust change that?
No. The San Diego County Auditor and Controller's list of active Mello-Roos districts for fiscal year 2025-2026 includes Carlsbad CFD #1, CFD #3 Faraday/Melrose and four Carlsbad Unified School District CFDs. A special tax is levied on the parcel, so the deed into your trust neither ends it nor starts a new one. The successor trustee keeps paying it with the property tax installments, and the administrator listed on the county's list can give a payoff figure if the trustee later sells.
Will my children keep my property tax base when they inherit my Carlsbad home?
Only if they meet Proposition 19, and a trust does not change that. The home must have been your principal residence and must become the principal residence of at least one child, who files for the homeowners' exemption within one year. Even then, for transfers from February 16, 2025 to February 15, 2027, the protection stops at your factored base year value plus $1,044,586, and any market value above that is added to the taxable value.
