A probate case belongs in the county where the person who died was living, wherever the death happened (Probate Code §7051). For a Clovis resident that is Fresno County, and the court's Probate Division page gives its address as the third floor of the B.F. Sisk Courthouse on O Street in downtown Fresno. The same rule pulls in property outside the county. A Clovis widow who also owned a cabin in the Sierra foothills in Madera County, or a rental in Visalia, would have one probate in Fresno County covering everything that was not in a trust or otherwise set up to pass outside court.

The court's page describes how a Fresno County probate moves. Before each hearing a probate examiner reads the petition to see whether it meets the procedural requirements of the Probate Code, and the examiner's notes, which list possible deficiencies to correct before the hearing, can be read online once you register an account on the court's case portal. Anyone who wants to appear by Zoom instead of in person files a Notice of Remote Appearance, form RA-010, at least five court days before the hearing and includes an email address. Since July 1, 2025, parties who have a lawyer must accept electronic service, and the court posts the forms used to confirm an electronic service address.

For a family, each of those steps is a deadline someone has to watch: a petition to prepare, notice to the heirs, examiner notes to answer, a hearing date to keep, and later an inventory, a probate referee's appraisal and usually an accounting before the estate can close. The case file is public. When your Clovis house and accounts are already titled in your living trust, the successor trustee you chose steps in under the trust document, and none of it goes through the courthouse on O Street.

Clovis has its own city hall, on Fifth Street, but deeds are a county function. The Fresno County Recorder's contact page lists one office, at 1250 Van Ness Avenue in Fresno, and that is where a deed for a Clovis home is recorded. Signing the trust alone leaves the house in your name. Title changes only when a deed from you, as owner, to you, as trustee of your trust, is recorded with the Recorder, describing the parcel by the legal description in your current deed and its Assessor's Parcel Number. Questions about assessed value or a later parent and child transfer go to a different building, the Assessor's office in the Hall of Records on Tulare Street.

On the Recorder's posted schedule, page one of a document costs $19.00 and every page after it $3.00. The same schedule shows an $11.00 first page for a conveyance document that contains transfer tax, and a deed into your own trust pays no transfer tax. The SB 2 housing fee is $75 per parcel. Since May 26, 2025, Fresno County charges it on each parcel named in a multi-parcel document, unless a parcel is exempt under Government Code §27388.1, with a cap of $225 per parcel. The county's SB 2 cover page includes the line "Document is a transfer of real property that is a residential dwelling to an owner-occupier," and warns that leaving off an exemption reason means the $75 fee is charged. Clovis also has a city transfer tax. California City Finance's table of city transfer tax rates, effective December 1, 2025, lists Clovis as a general law city with a city rate of $0.55 per $1,000 of value and a county rate of $0.55, for a combined $1.10. A transfer into your own revocable trust usually pays no transfer tax because no price is paid; the deed states the exemption. Confirm with the county recorder. On the county side, Fresno County's Documentary Transfer Tax Declaration, revised July 10, 2025, carries item 17: "This conveyance transfers an interest into or out of a Living Trust, R & T 11930."

Revenue and Taxation Code §62(d) says a transfer into a trust you can revoke is not a change in ownership. You check that exclusion on the ownership report, the Assessor keeps your Proposition 13 base year value, and no supplemental tax bill follows. From January 1, 2027, AB 2224 (Stats. 2026, ch. 292) sets the statutory base recording fee under Government Code §27361 at $15.00 for the first page and $4.00 for each additional page; county add-on fees are still charged on top, so the county's posted totals will change. What Probate Would Cost on a Clovis Home

Zillow's Home Value Index put the typical Clovis home value at $516,830 for August 2026 (research data through August 31, 2026). That figure is used in the table. Probate Code §10810 pays the estate's attorney a statutory fee figured on the gross value of the estate: 4% of the first $100,000, 3% of the next $100,000 and 2% of the next $800,000. Probate Code §10800 pays the executor the same amount. Gross value means a mortgage is not subtracted, so a Clovis house with a large loan on it costs as much to probate as one owned free and clear.

Clovis ZIP codes and the $750,000 petition

The citywide figure hides a wide spread. Zillow's August 2026 typical values by ZIP code were $376,279 in 93612, $493,384 in 93611 and $605,335 in 93619. ZIP code areas do not follow the city limits exactly, so these include some homes outside the city. Run through the same statutory schedule, the attorney and executor fees in a full probate would be $21,051.16 on the 93612 figure, $25,735.36 on the 93611 figure and $30,213.40 on the 93619 figure.

For a death on or after April 1, 2025, Probate Code §13151 lets heirs ask the court to transfer the decedent's primary residence without a full probate if the home is worth $750,000 or less. The citywide typical value and all three ZIP code figures are under that number today, but three limits matter. The petition is still filed with the Probate Division at the Sisk Courthouse, with a $435 filing fee, notice to the heirs and a wait of at least 40 days after the death. It reaches only the home the decedent lived in, so a rental condominium or a second house goes through full probate. And the test is the value on the date of death. A 93619 home at $605,335 is $144,665 below the limit; a few years of growth could close that gap, and the petition would then be unavailable.

How Clovis values have moved

Zillow's Clovis series shows how quickly a home can cross a value line. The typical value reached $388,402 in August 2006, fell to $204,267 by January 2012, climbed to $512,821 by June 2022, and hit its high of $517,918 in February 2025. The August 2026 figure, $516,830, is about 1% above the $511,874 of August 2025. Other value tests work the same way: personal property passes by a simple affidavit under Probate Code §13100 only if the estate is $208,850 or less, and the affidavit for real property of small value under §13200 stops at $69,625. A trust holds the home whatever it is worth when you die.

Clovis Homes, Households and Your Trust

A city of newer detached homes

The Census Bureau estimates Clovis had 129,347 residents on July 1, 2025, up from a 2020 base of 120,166. The 2024 American Community Survey counts 49,505 housing units in the city. Of those, 36,608, about 74%, are detached single family houses, and 20,567, about 42%, were built in 2000 or later; the median year built is 1995. Owners occupy 30,467 of the 46,626 occupied homes, about 65%, and renters the other 16,159. Married couple households make up 24,241 of the 46,626, about 52%, and 16,478 households, about 35%, include someone under 18.

Those numbers point to the documents most Clovis families need. A married couple who own a tract house together usually sign one joint trust, at $500. What happens to it when the first spouse dies depends on how the trust is written; many split into a share the survivor can still change and a share that becomes irrevocable, while simpler trusts leave the survivor in control of everything. Parents of minor children can nominate a guardian in a will or any signed writing (Probate Code §§1500 and 1502), and the pour-over will is where we put that nomination. Without a trust, a child who inherits usually needs a court supervised guardianship of the estate and receives the money outright at 18. A trust can hold the child's share and pay it out at the ages you pick.

Owners over 65 and planning for incapacity

Of the 30,467 owner households in Clovis, the survey counts 10,127, about one in three, headed by someone 65 or older: 6,046 aged 65 to 74, 3,432 aged 75 to 84 and 649 aged 85 or older. Just over half of those older owners, 5,238, have no mortgage. If a house is in your own name and you can no longer sign, your family needs a durable power of attorney that reaches real estate or, without one, a court conservatorship before the house can be sold or refinanced. If it is in your trust, the successor trustee you named can manage, rent or sell it under the trust's terms.

The rest of the package covers the decisions a trust does not. The durable power of attorney lets your agent handle accounts and matters outside the trust. The advance health care directive names who makes medical decisions for you. Without one, California law (Probate Code §4712) lets your doctors choose a surrogate from your spouse or domestic partner, adult children, parents, siblings, grandchildren, or another relative or close friend who knows your values. The directive lets you make that choice yourself.

Mortgaged homes and the due-on-sale clause

About two out of three Clovis owner households, 20,559 of 30,467, still have a mortgage. A common worry is that deeding the house to a trust will let the lender call the loan. Federal law answers that. Under 12 U.S.C. §1701j-3(d)(8), for a home with fewer than five dwelling units, a lender may not use a due-on-sale clause on "a transfer into an inter vivos trust in which the borrower is and remains a beneficiary and which does not relate to a transfer of rights of occupancy in the property." A revocable living trust in which you remain the beneficiary and keep living in the house fits that description. The loan stays as it is and you make the same payments. Send your lender and your homeowner's insurer a copy of the recorded deed so their records show the trust.

Assessment districts and the Dry Creek Preserve CFD

Some Clovis neighborhoods sit inside special districts that pay for local improvements. The City's annual financial report for the year ended June 30, 2024 lists custodial funds for three assessment districts: Blackhorse III (95-1), whose fund covers maintenance there of streets, curb and gutter, street lighting, sidewalks and gates, the Temperance Barstow Assessment District and the Shepherd Temperance Assessment District. It also lists Community Facilities District 2020-1 for Dry Creek Preserve, which collects money to maintain temporary public sewer facilities and later replace them with permanent ones. A district assessment or special tax is tied to the parcel, not to the owner. Moving the house into your trust does not end it or change it. Tell your successor trustee to check the property tax bill for district charges and to keep them paid from the trust while the house is being sold or distributed.

Older houses and older deeds

Clovis was incorporated in 1912, and the American Community Survey counts 1,162 homes in the city built before 1950. An older house may carry a legal description that refers to an old subdivision map, and it may have passed through several deeds, a probate or a joint tenancy that ended with a death. We prepare the trust deed from the description in your most recent recorded deed, not from the street address. If title still shows a spouse or parent who has died, that should be cleared before or along with the trust deed, because a trust can only hold what you own.

Mobile homes and multi-unit property

The survey also estimates 796 mobile homes in Clovis, along with 3,690 homes in buildings of three or four units and 2,359 in buildings of 50 or more. A manufactured home titled with the state Department of Housing and Community Development moves into a trust through HCD's own transfer forms, not by a recorded deed; HCD has separate trust transfer instructions depending on whether the home pays local property tax or an in-lieu license fee. If you own the land under it, the land is deeded to the trust like any other parcel. A fourplex or a rental condominium you do not live in is deeded the same way, and its deed pays the $75 SB 2 fee because the owner-occupier exemption does not apply. Those rentals gain the most from a trust, since the §13151 home petition never reaches them.

A free recording alert from the county

Deed fraud happens when someone records a forged deed to a house they do not own. Fresno County's Assessor-Recorder offers a free service, Property Owner's Protection Alert, that sends an email whenever a document is recorded under a name or Assessor's Parcel Number you register. Each email address can register up to ten names and ten parcel numbers, and the county says trust names can be registered. After your trust deed is recorded, add your trust's name next to your own name and the parcel number, so a later document under either name comes to your inbox.

School district, hospital and county jobs

The City's 2024 annual financial report lists Clovis Unified School District as the largest employer in the city with 5,228 workers, followed by Clovis Community Hospital with 2,988, the County of Fresno with 1,874, Walmart with 890 and the City of Clovis with 767. Retirement money and group life insurance from these employers, including public pensions and 403(b), 457 and 401(k) plans, goes to whoever the plan's beneficiary form names, outside both the trust and the will, so the trust controls them only if a form names it. When we prepare your trust we go through those designations with you so they match the plan. A parent who wants a child's share held in trust needs the retirement and life insurance forms to say so.

Passing the home to your children

A trust keeps the house out of probate; it does not decide the property tax your children pay. Under Proposition 19, a child who inherits a parent's home keeps the parent's taxable value only if at least one inheriting child makes it a primary residence and files for the homeowners' exemption within one year. The protection is capped at the existing taxable value plus $1,044,586 for transfers from February 16, 2025 to February 15, 2027, and the claim form, BOE-19-P, is due within three years. A rental does not qualify, so children who keep a Clovis rental will see it reassessed. The trust can say whether the house is to be sold or kept, and by whom.
