People in Orange tend to assume their court business happens close to home, because the Superior Court has a large courthouse in the city: the Lamoreaux Justice Center at 341 The City Drive South. That building is assigned juvenile delinquency, dependency, family law and domestic violence cases. Probate is not on its list. The court's designation list, effective June 30, 2025, says probate, mental health and elder and dependent adult abuse restraining order cases are heard at the Costa Mesa Justice Complex and every city's row on that list, Orange's included, follows that rule. So a family in Orange that needs to probate a parent's house drives to Harbor Boulevard in Costa Mesa, and files its papers electronically before it ever gets there.

Lamoreaux does have one thing an Orange family may use: an in-person self-help center, open Monday through Thursday from 8:00 a.m. to 4:00 p.m. and Friday until 3:00 p.m., according to the court's probate self-help page. A trust you have signed but never funded does nothing for your house. Title moves only when a trust transfer deed, from you as owner to you as trustee, is recorded. The City of Orange has no recording office. The Clerk-Recorder takes real property recordings at its main office on Ross Street in Santa Ana, at the North County branch in the Wells Fargo Building on Harbor Boulevard in Anaheim, and at its South County office in Laguna Hills (24031 El Toro Road, Suite 160). For most in-person services the county requires a service application before the visit; real property recordings are the exception. Deeds may also be mailed.

The office you are more likely to deal with in person sits in the city itself. The Orange County Assessor's main office is at 500 S. Main Street in Orange, with weekday hours of 8:00 a.m. to 5:00 p.m., with a separate phone line for change of ownership questions and another, (714) 834-3821, for the homeowners' exemption. The PCOR you send with the deed is the Assessor's form, and it has a box for a transfer into or out of a revocable trust. Under Revenue and Taxation Code §62(d) that transfer is not a change in ownership, so your Proposition 13 base year value carries over to the trust.

On the fee side, the county's documentary transfer tax is $0.55 per $500 on a sale, and on a deed into your own revocable trust the county line shows $0.00 with the Revenue and Taxation Code §11930 exemption written on the deed. City transfer tax

Some California cities levy a transfer tax of their own on top of the county's. For the deed that funds your trust: A transfer into your own revocable trust usually pays no transfer tax because no price is paid; the deed states the exemption. Confirm with the county recorder. The county line on the deed is a separate question, answered above.

One practical point about city lines. Villa Park is a separate city, listed on its own row in the court's designation list, and an Orange mailing address does not by itself put a parcel inside the City of Orange. The legal description and Assessor's Parcel Number on your current deed control which city's rules apply, and the trust transfer deed copies them exactly.

Old Towne, 1960s Tracts, Fire Zones and Your Trust

A city of long-held houses

The Census Bureau's Vintage 2025 estimate puts the City of Orange at 138,365 residents on July 1, 2025, from a 2020 base of 139,910. Much of its housing is decades old. The American Community Survey for 2020 to 2024 counts 46,952 housing units and estimates that 11,881 of them (25.3%) were built in the 1960s, 6,062 (12.9%) in the 1950s and 9,078 (19.3%) in the 1970s, with 2,155 (4.6%) built in 1939 or earlier. About 6% were built in 2010 or later. Detached single family houses are 55.8% of the stock, and 56.7% of occupied homes are lived in by their owners.

A house bought decades ago usually carries a Proposition 13 value far below its market value, and that is where families in Orange get surprised. A living trust avoids probate. It does not let the children keep the parent's tax base. Under Proposition 19 the exclusion applies only if a child makes the house a principal residence and claims the homeowners' exemption within one year, and only up to the parent's factored base year value (the Proposition 13 value) plus $1,044,586 for transfers from February 16, 2025 to February 15, 2027. The Board of Equalization explains that market value above that limit is added to the child's taxable value.

Take a hypothetical. A parent's factored base year value is $150,000, so the limit is $1,194,586. At Zillow's citywide typical value of $1,125,988 the house is under the limit and a child who moves in keeps the $150,000 base. At the August 2026 ZIP code value for 92867, $1,233,777, the house is $39,191 over the limit, and the child's taxable value becomes $189,191. A child who keeps the house as a rental, or moves out later, gets a new assessment at market value. Those numbers are worth having in front of you when you decide which child receives the house and who serves as trustee.

Old Towne, the Eichler tracts and Mills Act contracts

The city's 2021 housing element progress report describes enforcement of the Old Towne Design Standards and the Eichler Design Standards in its established historic districts, and a Mills Act program under which the city approved and recorded 36 new contracts in 2021 alone. A Mills Act contract lowers the property tax on a qualified historic house in exchange for the owner's promise to preserve and restore it.

For a trust, the statute is what counts. Government Code §50281 requires each contract to run for at least ten years and to bind all successors in interest, who take the same rights and obligations as the original owner; §50282 adds a year to the term on each anniversary unless someone gives notice of nonrenewal. Deeding the house into your trust does not end the contract. It also means your successor trustee, and later your children, inherit the duties: preserving the house, restoring it where the contract calls for it, and allowing the inspections the statute requires before a new contract and every five years after that. If the city finds the contract breached, §50284 lets it cancel, and §50286 then charges a cancellation fee of 12.5 percent of the current fair market value. The Old Towne Preservation Association reported in January 2026 that the city planned a second letter to contract holders it considered out of compliance, about 40 properties, and that new applications remained on hold. Put the contract and your restoration records with your trust papers, and tell your successor trustee the contract exists.

A mortgage does not stop you funding the trust

With about seven in ten Orange owners still paying a loan, a common worry is that the lender will call it when the house moves into the trust. Federal law answers that. The Garn-St Germain Act, at 12 U.S.C. §1701j-3(d)(8), bars a lender from exercising a due-on-sale clause on residential property of fewer than five units when the transfer is into an inter vivos trust in which the borrower is and remains a beneficiary and the transfer does not relate to a transfer of rights of occupancy in the property. The same subsection covers a lien on a residential manufactured home. The loan stays where it is and you keep making the same payments.

Townhomes, condominiums and mobile homes

The same survey estimates 4,580 single family attached homes in Orange, plus 9,723 units in buildings of five or more. A townhome or condominium unit is deeded into the trust like a house, and one deed covers the unit and its share of the common area. Send the association a copy of the recorded deed so its records match.

The survey also counts 1,182 mobile homes in the city, 2.5% of the housing stock. A manufactured home titled with the state Department of Housing and Community Development moves into a trust through HCD, not through a deed recorded with the county. HCD's instructions for moving a home on the local property tax roll (decal number beginning with L) into a trust call for the original title signed by every owner, the registration card, an original tax clearance certificate from the County Tax Collector, the Multi-Purpose Transfer Form signed by each trustee, a $35 transfer fee and a $23 registration fee per section, with other fees in some cases.

Fire hazard zones in the hills

Not all of Orange is a suburban grid. The city's Wildfire Fuel Management Project, filed with the state in October 2025, clears vegetation on 284 acres within high and very high fire hazard severity zones in the city's wildland urban interface, protecting neighborhoods such as Serrano Heights and Orange Hills and evacuation routes such as Santiago Canyon Road. If your house is up there, two points belong in your planning. First, tell your insurer when the house goes into the trust and ask that the trust be shown on the homeowner's policy, so your successor trustee can deal with a claim for property the trust holds. Second, a sale. California's natural hazard disclosure statute exempts sales by a fiduciary in the course of administering a trust, but that exemption does not apply to a sale by a natural person who is trustee of a revocable trust when the seller is a former owner of the house or was an occupant in possession of it within the preceding year (Civil Code §1103.1(a)(3)). If you sell as trustee of your own trust, expect to give the full disclosure, and other disclosure rules can apply even where that statute does not (§1103.1(b)).

Older owners, living alone, near the hospitals

The American Community Survey estimates that 31.5% of the city's 45,329 households include someone 65 or older, and that about 4,248 households are a person 65 or older living alone. For those owners, the more likely problem is a hospital stay, not a probate. Orange is home to two large hospitals, CHOC at 1201 W. La Veta Ave. and Providence St. Joseph Hospital at 1100 W. Stewart Dr. If you are admitted and cannot speak for yourself, the advance health care directive names who makes medical decisions, the HIPAA authorization lets the people you name receive information, and the successor trustee can pay the property tax and the mortgage on the house you own through the trust. For someone who lives alone, naming a first and a second successor trustee who live nearby is worth more than any other single choice in the trust.

When an owner dies, the house is still recorded in the name of the trustee who died until someone records proof of the death. Probate Code §210 lets any person record, in the county where the property is located, an affidavit of death that describes the property and attaches a certified copy of the death record. In Orange County that affidavit goes to the Clerk-Recorder, which charges $26.00 for a certified copy of a death certificate. After that the successor trustee can sign as trustee to sell the house or deed it to the beneficiaries.
