Tarzana Living Trust: Protecting Country Club Estates & Professional Families

Reviewed by Rozsa Gyene, California attorney. Last reviewed October 2026.

Tarzana is in the San Fernando Valley, but a Tarzana probate is not. A Tarzana estate that needs probate is filed and heard downtown at the Stanley Mosk Courthouse. On a home at Zillow's typical Tarzana value of $1,160,996, the statutory attorney and executor fees add up to $49,219.92. We prepare a living trust for $400 (one person) or $500 (married couple), reviewed by a California attorney.

Quick Answer

A Tarzana house still titled in your own name at death goes through probate at the Stanley Mosk Courthouse downtown; the Van Nuys courthouse does not hear probate. A revocable living trust avoids that once you deed the house to yourself as trustee and record the deed with Los Angeles County. At Zillow's August 2026 typical Tarzana value of $1,160,996, Probate Code §10810 and §10800 allow the attorney and the executor $24,609.96 each, $49,219.92 together. Our trust is $400 for one person or $500 for a couple, plus $100 per deed.

Long trials

Stanley Mosk Courthouse on North Hill Street in downtown Los Angeles, where Tarzana probate cases are filed and heard

Families in Tarzana often assume an estate case would stay in the Valley, at the courthouse in Van Nuys. It does not. Local Rule 2.3 of the Los Angeles Superior Court puts probate, trust, conservatorship and guardianship matters in the Central District, and the court's judicial directory for the week of October 5, 2026 lists probate departments only at Mosk and at the Metropolitan Courthouse, none at Van Nuys, Chatsworth or any other Valley courthouse. So the petition to probate a house on a Tarzana side street is filed downtown on Hill Street, the same as one from Hollywood or San Pedro. A contested case headed for a long trial moves to Department 64 at the Metropolitan Courthouse, 1945 S. Hill Street, which the court began using for long-cause probate trials on September 15, 2025.

The same rule matters for incapacity, not only for death. If you become unable to manage your affairs and nothing is in place, a relative has to ask the court to appoint a conservator, and that petition also goes to the Central District. A funded trust with a named successor trustee, together with a durable power of attorney for anything outside the trust, is how a family avoids that second kind of court case.

What a probate involves: a petition to appoint the personal representative, a published notice, an inventory appraised by a probate referee, a creditor period of at least four months after letters are issued (Probate Code §9100), and a final petition before anything is distributed. The first petition costs $435 to file under the statewide fee schedule effective January 1, 2026, and the file is open to the public. A successor trustee skips all of it. He or she takes over the trust property, pays the bills, gives the notices the Probate Code requires and deeds the house to your beneficiaries without a judge's order. Our article on Los Angeles County probate judges and departments describes the Mosk courtrooms in more detail.

Signing a trust does not move your house into it. The house goes in when a deed from you, as owner, to you, as trustee, is recorded. We copy the legal description and the Assessor's Parcel Number from your current deed, so look for it in your closing papers or ask us to pull it. With the deed goes the Preliminary Change of Ownership Report, on which you mark the transfer into a revocable trust. Revenue and Taxation Code §62(d) says that transfer is not a change in ownership, so the Assessor does not reassess and no supplemental tax bill follows. Our living trust property tax guide goes through the form.

The $75 SB 2 fee is usually not charged on a deed moving your own home into your trust, because we claim the owner-occupier exemption of Government Code §27388.1(a)(2) on the face of the deed. It is charged on rentals, second homes and vacant land, up to $225 per transaction. A Tarzana owner who also holds a condominium on Ventura Boulevard as a rental, or a lot in another county, should expect that fee on each of those deeds.

The county transfer tax line on the deed reads $0.00. Los Angeles County requires the reason for any exemption to appear on the document, and the Registrar-Recorder's list of accepted statements includes one for a transfer into or out of a living trust under Revenue and Taxation Code §11930. Because Tarzana lies inside the City of Los Angeles, the deed shows the county tax and the City tax separately. A transfer into your own revocable trust usually pays no transfer tax because no price is paid; the deed states the exemption. Confirm with the county recorder.

Recording costs change in 2027. AB 2224 (Stats. 2026, ch. 292) raises the Government Code §27361(a) base fee from $10 to $15.00 for the first page and from $3 to $4.00 for each additional page from January 1, 2027. The Registrar-Recorder's notice of September 24, 2026 says it will apply the new base fee to documents received on or after January 1, 2027, subject to Board approval and notice, and will drop several smaller fees; when we checked on October 6, 2026 it had not posted new totals. We prepare the deed and the PCOR for $100 per property and you record them. The trust transfer deed guide explains each line of the form.

Probate Fees on a Typical Tarzana Home

The figures below use Zillow's Home Value Index for the Tarzana neighborhood, which shows a typical home value of $1,160,996 for August 31, 2026. Probate Code §10810 sets the estate attorney's fee as a percentage of the gross estate: 4% of the first $100,000, 3% of the next $100,000, 2% of the next $800,000 and 1% of the next $9,000,000. Section 10800 gives the executor the same amount. Gross means no deduction for the mortgage or a home equity line.

Run your own numbers in the probate cost calculator

A typical value is only a midpoint, so many Tarzana homes are worth more, and the statutory fee rises with every dollar of gross value. Neither shortcut in the Probate Code helps at these prices. The §13100 small estate affidavit is limited to $208,850, and the §13151 petition for a primary residence to $750,000, both for deaths on or after April 1, 2025, and §13151 is still a court petition with notice and a hearing. Our California probate fees guide explains extraordinary fees, which the court can add on top of the statutory amounts. A trust costs $400 for one person or $500 for a married couple.

Tarzana Property, Businesses and Hillsides

A neighborhood of Los Angeles, with the City's transfer tax

Tarzana covers about 8.79 square miles. Victory Boulevard is its northern edge, Lindley Avenue the eastern, Corbin Avenue (with a jog to Oakdale Avenue) the western, and Topanga State Park the southern, with Encino to the east, Reseda to the north and Woodland Hills to the west. The Census counted 35,502 residents in 2000, and the City of Los Angeles estimated 37,778 in 2008. Its ZIP codes are 91356 and 91357, and some Tarzana addresses use 91335. It has no city government of its own, so its homes are inside the City of Los Angeles for every purpose that depends on city limits.

That matters on a sale. Los Angeles Municipal Code §21.9.2 taxes deeds conveying realty sold within the City at $2.25 per $500, on top of the county's $0.55 per $500, and the Measure ULA tax applies to high value sales. For sales closing after June 30, 2026, the City's Office of Finance charges ULA at 4% above $5,400,000 and below $10,900,000, and 5.5% at $10,900,000 or more. Take a sale at the typical Tarzana value with no loan staying on the property: $1,160,996 rounds up to $1,161,000, or 2,322 units of $500, so the county tax is $1,277.10 and the City tax $5,224.50, $6,501.60 in all, with no ULA. A transfer into your own revocable trust usually pays no transfer tax because no price is paid; the deed states the exemption. Confirm with the county recorder. Both that deed and a successor trustee's deed distributing the house to your children carry the R&T §11930 living trust statement for the county's tax. The tax does apply if the trustee sells. A trust avoids probate; it does not make a sale tax free.

From Tarzana Ranch to a family company

The neighborhood takes its name from a business decision. On March 1, 1919, Edgar Rice Burroughs bought the tract that Harrison Gray Otis had acquired in the middle of today's Tarzana, called it Tarzana Ranch, and later subdivided and sold it for homes. In 1923 he formed Edgar Rice Burroughs, Inc.; he was one of the first artists to incorporate, for tax reasons and to keep control of his works. The company is still based in Tarzana, still owned by his family, and still licenses Tarzan and John Carter of Mars.

The lesson for a Tarzana household is that a business interest or a creative right is property, and a trust controls it only if it has been moved in. Shares in a family corporation or an LLC that holds a rental are assigned to the trust in writing, after checking the bylaws, operating agreement or shareholder agreement for transfer limits. Shares in a medical or dental professional corporation are different: Corporations Code §13407 allows them to be transferred only to a licensed person, another shareholder of the same corporation or a professional corporation, and a transfer that breaks that rule is void, so those shares are not assigned to a trust without first checking with the corporation's own lawyer. Copyrights can be transferred by any means of conveyance and can pass by will (17 U.S.C. §201(d)); a transfer other than by operation of law must be in a writing signed by the owner (17 U.S.C. §204(a)). For works created on or after January 1, 1978, copyright lasts for the author's life plus 70 years (17 U.S.C. §302(a)). Royalty statements keep arriving long after the author dies. An assignment of the copyrights and the publishing or licensing contracts to the trust lets the successor trustee collect and divide that income without a probate case to establish who owns it.

Hillside lots and brush clearance

Tarzana's southern edge is Topanga State Park in the Santa Monica Mountains, and Caballero Canyon, on the north side of the range inside Tarzana, has hiking trails. In the City's Very High Fire Hazard Severity Zone, the Los Angeles Fire Department requires property owners to keep native brush, weeds and grass cleared within 200 feet of structures all year, under Los Angeles Municipal Code §57.4906.5.2, and it lets anyone look up a parcel's brush clearance status online. That is an owner's duty, and when the owner is ill or has died, somebody with authority must hire the crew and pay for it. With the lot in a trust, that person is the successor trustee. On March 24, 2025 the State Fire Marshal also issued updated fire hazard severity zone maps for Los Angeles County's local responsibility areas, with an online map viewer. After the deed records, ask your homeowner's insurer to add you as trustee, so a claim after a fire or an earthquake is not delayed by a question of who owns the house.

Gated streets and country clubs

Part of Tarzana lives behind gates, such as Mulholland Park, and two country clubs sit in the neighborhood: El Caballero Country Club on Tarzana Drive and Mulholland Hills Country Club (until 2025 called Braemar Country Club) on Reseda Boulevard. A trust deed does not change the CC&Rs, the assessments or the gate rules; the association simply has a trustee as owner of record. Send the association a copy of the recorded deed and a contact for your successor trustee so dues keep being paid and gate access keeps working. A club membership is a different matter. It is governed by the club's own bylaws, not by your deed, and a trust cannot override them. Before you sign, ask the club what happens to a membership when a member dies or becomes incapacitated, and whether any equity in it can pass to a family member. If something can pass, the trust should say who receives it.

Planning for illness as well as death

The Los Angeles Times Mapping L.A. profile of Tarzana, drawn from the 2000 Census and summarized on Wikipedia, put its share of residents 50 and older among the highest in Los Angeles County. Providence Cedars-Sinai Tarzana Medical Center is in the neighborhood, on Clark Street. For an older household, the trust's most frequent job is incapacity, not death. The successor trustee steps in for trust assets when the trust's incapacity terms are met, without a court order, the durable power of attorney covers retirement accounts and anything else outside the trust, and the advance health care directive with its HIPAA authorization lets the hospital talk to the person you named. Keep a copy of the directive where family can find it, and give one to your doctor.

Family and property in other countries

The same profile showed 35.1% of Tarzana residents born abroad, with Iran the most common country of birth among them. A California trust deed records only in the county where the land lies. It cannot move an apartment in Tehran or land in another country, which follows the law of the place where it sits. What a California trust can do is hold your California real estate and your U.S. accounts, and name beneficiaries who live overseas. List foreign property and accounts in the questionnaire so the plan accounts for them, and get advice in that country about how the property passes.

When your children inherit the house

A trust keeps the house out of probate; it does not decide the property tax. Under Proposition 19 a child keeps the parent's taxable value only when a child who inherits moves in as a primary residence and claims the homeowners' exemption within one year, and even then only up to the parent's taxable value plus $1,044,586 for transfers from February 16, 2025 through February 15, 2027. The BOE-19-P claim goes to the Los Angeles County Assessor within three years. A Tarzana house bought decades ago can be worth well over that cap, so the excess is reassessed even if a child moves in. Your trust can say which child may keep the house and how the others are paid. See the Prop 19 inheritance guide for examples.

How to Create and Fund a Living Trust in Tarzana

  1. Fill in the questionnaireTell us about your family, your Tarzana home and any other real estate, your bank and investment accounts, any company shares, royalties or copyrights you own, and whom you want as successor trustee and as guardian of minor children.
  2. Your documents are drafted and reviewed by a California attorneyRozsa Gyene prepares the trust, pour-over will, durable power of attorney, advance health care directive and certification of trust from your answers and reviews them before they are sent to you.
  3. Sign in front of a notary and two witnessesA California notary takes your signature on the trust and the power of attorney; there are notaries in Tarzana and throughout the Valley. Two adult witnesses watch you sign the pour-over will. The signing instructions explain each signature.
  4. Record the trust transfer deed with Los Angeles CountyTake the deed and the Preliminary Change of Ownership Report to the Registrar-Recorder's Van Nuys branch or another office that records documents, or mail them to Norwalk. The county transfer tax line shows $0.00 under the living trust exemption, and the deed for the home you live in claims the SB 2 owner-occupier exemption. A transfer into your own revocable trust usually pays no transfer tax because no price is paid; the deed states the exemption. Confirm with the county recorder.
  5. Move accounts, shares and rights into the trustGive each bank and brokerage the certification of trust and retitle the account to you as trustee. Sign assignments for shares in a family company and for copyrights or royalty contracts, after checking any transfer limits in the company's bylaws or the contract.
  6. Update beneficiary forms and insuranceCheck the beneficiary forms on retirement accounts and life insurance, which pass outside the trust, and ask your homeowner's insurer to add you as trustee on the policy once the deed has recorded.

What the $400 Tarzana Package Includes

The trust is $400 for an individual and $500 for a married couple, and each deed is $100. The office is at 3500 W. Olive Ave., Suite 300, in Burbank, and the attorney answers at (818) 337-4071, but everything can be done from home in Tarzana: the questionnaire online, the signing with a notary near you, and the deed recorded at Van Nuys or by mail. Tarzana Living Trust Questions

Is there a probate court in the San Fernando Valley that would hear a Tarzana estate?

No. The Superior Court's Valley courthouses, including Van Nuys and Chatsworth, do not hear probate; the court's judicial directory lists probate departments only at Mosk and at the Metropolitan Courthouse. Los Angeles Superior Court Local Rule 2.3 assigns probate, trust, conservatorship and guardianship matters to the Central District, so a Tarzana estate is filed and heard at the Stanley Mosk Courthouse, 111 N. Hill Street, in downtown Los Angeles. Contested probate matters set for a long trial go to Department 64 at the Metropolitan Courthouse, 1945 S. Hill Street.

How much would probate cost on a typical Tarzana home?

Zillow put the typical Tarzana home value at $1,160,996 on August 31, 2026. On that gross value, Probate Code §10810 gives the estate's attorney $24,609.96 and §10800 gives the executor the same amount, so the two statutory fees total $49,219.92. A mortgage does not lower the figure. The $435 first petition filing fee and a probate referee commission of about $1,161 come on top. Our trust is $400 for one person or $500 for a married couple.

Where do I record the deed that puts my Tarzana house in my trust?

The Los Angeles County Registrar-Recorder/County Clerk records it. The office closest to Tarzana that records documents is the Van Nuys branch at 14340 W. Sylvan Street, open weekdays from 8:30 a.m. to 4:30 p.m. You can also use the main office at 12400 Imperial Highway in Norwalk, the LAX/Courthouse branch on La Cienega Boulevard, or the Lancaster branch, or mail the deed to the Document Analysis and Recording Section, P.O. Box 1250, Norwalk, CA 90651-1250.

Does the City of Los Angeles transfer tax or Measure ULA apply when I deed my Tarzana home to my trust?

Tarzana is inside the City of Los Angeles, so a sale there owes both the county tax and the City tax. A transfer into your own revocable trust usually pays no transfer tax because no price is paid; the deed states the exemption. Confirm with the county recorder. For the county's tax, our deeds carry the living trust exemption statement under Revenue and Taxation Code §11930, which Los Angeles County lists among the statements it accepts. The City treats transactions exempt from its base tax as exempt from the Measure ULA tax as well.

Will my country club membership pass through my trust?

Not automatically. A club membership is governed by the club's own bylaws and membership rules, not by the deed to your house or by your trust. Some memberships end at death, some can pass to a spouse, and some carry an equity interest that may have a value. Ask the club how its rules treat a member's death or incapacity, and tell us what the club says so the trust can name who should receive any transferable interest.

Who takes care of brush clearance on my hillside lot if I become ill?

If the lot is in the trust, your successor trustee does. The Los Angeles Fire Department requires owners of property in the City's Very High Fire Hazard Severity Zone to keep brush, weeds and grass cleared within 200 feet of structures all year, under Los Angeles Municipal Code §57.4906.5.2. A successor trustee can hire the crew and pay for it from trust funds without waiting for a court to appoint a conservator. You can check a parcel's brush clearance status on the Fire Department's website.

Will moving my Tarzana home into a trust change my property tax bill?

No. Revenue and Taxation Code §62(d) treats a transfer into a trust you can revoke as no change in ownership, so the Los Angeles County Assessor keeps your Proposition 13 base year value. File the Preliminary Change of Ownership Report with the deed and claim that exclusion; recording without it adds a $20 fee in lieu under Revenue and Taxation Code §480.3(b).

Can my children keep my low property tax base when they inherit my Tarzana house?

Only in part, and the trust does not change that. Under Proposition 19 a child keeps the parent's taxable value only if a child who inherits moves in as a primary residence and claims the homeowners' exemption within one year. The protected amount is capped at the parent's taxable value plus $1,044,586 for transfers from February 16, 2025 through February 15, 2027, and the BOE-19-P claim must be filed with the Los Angeles County Assessor within three years.
